Investigation against Flávio Bolsonaro on the cracks scheme will only proceed if a new complaint is filed

Decision was made by the minister João Otávio de Noronha, of the STJ; as the evidence was canceled, bank statements collected from the breach of bank or tax secrecy cannot be used

Justice João Otávio de Noronha, of the Superior Court of Justice (STJ), decided that the criminal action that investigates an alleged crack scheme in the office of Flavio Bolsonaro in the Legislative Assembly of Rio (Alerj) the Public Ministry will only be able to present a new complaint. In addition, as the evidence has been canceled, bank statements and other evidence collected from the breach of bank or tax secrecy cannot be used. The decision met a request from the defense of Fabricio Queiroz, former advisor to Flávio.

Queiroz had already benefited from Noronha’s decision in March of this year, when the Fifth Panel of the STJ revoked, by 4 votes 1, the house arrest of the former advisor to President Jair Bolsonaro’s son 01 (no party). Later, in August, the minister suspended the processing of the complaint against the senator. Queiroz’s lawyers alleged that the complaint is based on illicit evidence, as it includes information obtained from the breach of confidentiality, which the court itself annulled in February. The minister accepted the appeal and extended the effects of the decision to another 15 defendants.
