An expert appointed by the Court of Justice of Rio de Janeiro understood that the broadcaster, in fact, used the same composition of the musician in football games without having authorization for this. The reporter had access to the expert report, attached to the process on the 15th. The judicial war, however, is still far from over. Now, the judge of the 2nd Business Court of Rio de Janeiro needs to accept the technical decision to condemn Globo and, then, define an indemnity amount for moral and property damages.
The 100-page report by Alexandre Hees de Negreiros, an expert chosen by the Judiciary and not in a particular way, indicates “substantive possibility of plagiarism”, with the description of instruments, rhythms and similar beats from one song to another.
“It was found the material derivation, voluminous and significant, resulting from the use (parasitic or by functional determination) of several musical elements susceptible to protection present in the original work ‘International Football’ and characteristic of its existence, through its unauthorized use” , concluded the expert, who added: “Secondly, there was a repeated refusal, by the person responsible for the material derivation, to attribute the authorship of the excerpts that he used to the one who created them, instead of assuming them as his own. And third and last Secondly, there were several attempts to conceal this exploitation”.
